Judge Orders Taxpayer Funded s*x Change for Convicted Murderer

In yet another interesting way to spend taxpayer money, a judge ruled that a convicted murderer should have a government-funded s*x change.  The judge says that the surgery is the only way to treat her “serious medical need” in a ruling handed down on Tuesday.

Michelle Kosilek was born a man, but received hormone treatments to help him live as a woman.  He is in an all-male prison population, where he was convicted of murdering a woman back in 1990. Kosilek had the name Robert when he murdered his wife, Cheryl.

US District Judge Mark Wolf is the first federal judge to ever order a s*x-reassignment surgery for a transgender inmate.  Kosilek’s suit began 12 years ago, when he sued the Massachusetts Department of Corrections.  The judge then ruled that Kosilek was eligible for treatment for gender-identity disorder, but didn’t offer him the surgery.  Kosilek sued again, stating that he needed the surgery.

The judge handed down a ruling that the surgery was the “only adequate treatment” for Kosilek and that “there is no less intrusive means to correct the prolonged violation of Kosilek’s Eighth Amendment right to adequate medical care.”

Prison officials argue that the surgery would make Kosilek a target of s****l assault from the other inmates, since she would be a woman inside a men’s prison.  But Wolf played that issue down and ordered the surgery regardless.  He left it in the hands of prison officials to decide what to do after that.

  1. Why would the taxpayers foot the bill for gender reassingment. Since when does having a s*x changed operation became part of someone’s eight amendment right
